The Real World
I've opined here before on the implications of reality for moral duties - when we have religious arguments for the minimum wage, for example, we ought to be critical of them for harming the people the policies purport to be helping. Don Boudreaux has a very clear statement of the role of the "real world" in law in response to Sen. Joseph Biden's pontificating on the need for judges to pay attention to the "real world" during the Alito hearings. Well worth reading;
